It is essential that organisations manage misconduct issues at an early stage and avoid the many procedural pitfalls that can ultimately lead to successful claims from employees in the Employment Tribunal. This workshop will highlight ten common areas where employers frequently trip up on procedure and offer simple and practical reminders of how to ensure misconduct disciplinaries and dismissals are dealt with as effectively and with the least risk possible.

Common problem areas include:-

  • Suspension: when is it appropriate to suspend and how should employees on suspension be dealt with?
  • Investigation: ensuring a balanced investigation and dealing with problem areas such as witness anonymity requests and on-going police investigations.
  • Communication: ensuring correspondence is clear, managed properly and contains relevant information.
  • Disciplinary hearings, dealing with unexpected issues and repeated postponement requests.
  • Consistency of approach between employees

The above and more issues will be discussed by Paul McGowan, Principal and Liane Atkin, Associate of specialist employment law firm, Collingwood Legal.
