Employment Tribunal Representation

We regularly represent clients at the employment tribunal. Our lawyers have acted in Tribunal's in England, Wales and Scotland. Our lawyers have also successfully acted in employment disputes at the Employment Appeal Tribunal, Court of Appeal and European Court of Justice.

Business Restructures and Reorganisation

We work closely with our clients to advise on the strategic management and legal risk associated with the restructure of their business. We have experience in dealing with redundancy exercises ranging from large scale site closures to redundancies involving a handful of staff. We ensure that matters are managed sensitively and carefully whilst protecting clients from the risk of claims.

We have particular expertise in dealing with larger scale reorganisations involving consultation with trade unions and employee representatives.

Our lawyers have been at the forefront of changes in the law for collective redundancy having successfully acted at the EAT in the landmark case of NUM and BACM v UK Coal.

Business Transfers and TUPE

Employment laws applying to business transfers are complicated and warrant the instruction of a true specialist. We are experienced in advising clients on issues arising from the Transfer of Undertakings (Protection of Employment) Regulations 2006 (TUPE).

Our experience includes advising both public and private sector employers on the outsourcing of services, acting as key advisers involved in the recent reorganisation of local government and dealing with multi-party tribunal claims.

The Collingwood Legal team regularly present to clients and at seminars on TUPE. Most notably, Paul McGowan is one of the few employment lawyers in the UK to have acted in a TUPE case at the European Court of Justice.

Contracts and Policy Documents

Settlement agreements are often used by employers to resolve employment issues without the risk of litigation. We have experience in working closely with employers to assess risk and prepare tailored settlement agreements to meet their needs.

We also provide independent legal advice to senior executives on the terms of settlement agreements.

Dealing with HR issues

We find that the vast majority of our clients would rather resolve HR issues before they become employment disputes. We work closely with our clients to achieve this aim offering advice on the full range of employment issues.

Diversity and Discrimination Issues

We regularly advise clients on the management of diversity and discrimination issues. Our lawyers have successfully acted in multi-day discrimination claims at Tribunal.

We keep up to date with changes in the law and are fully familiar with the Equality Act 2010. We have lectured and provided training to employers and employer bodies on the changes introduced by the 2010 Act.
